INTRODUCTION
This document is an electronic record in terms of the Information Technology Act, 2000 and the rules made thereunder. It is published in accordance with the provisions of Rule 3 of the Information Technology (Intermediary Guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy, and Terms of Use for access or usage of the e-commerce website and/or mobile application of Metro Mart (hereinafter collectively referred to as the “Platform”).
This electronic record is generated by a computer system and does not require any physical or digital signatures. The Platform is owned, operated, and managed by Metro Mart (hereinafter referred to as the “Company”, “We”, “Us”, or “Our”).
By accessing, browsing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use (“Terms”). These Terms do not apply to third-party products or services, which are governed by their respective terms.
TERMS
2.1 By accessing or using the Platform, you agree to comply with these Terms. We reserve the right to update or modify these Terms at any time without prior notice. These Terms constitute a legally binding agreement between you (“User”, “You”, “Your”) and Metro Mart.
2.2 A User includes any individual or entity who accesses, browses, or transacts on the Platform. By using the Platform, you also agree to our Privacy Policy and any other applicable guidelines or policies.
2.3 If you do not agree with these Terms, you must not use the Platform and should discontinue use immediately.
2.4 The Platform is intended for users who are at least 18 years of age. Minors may use the Platform only under the supervision of a parent or legal guardian.
USER REPRESENTATIONS
3.1 By using the Platform, you confirm that you are at least 18 years old and capable of entering into a legally binding contract under applicable laws.
3.2 You agree to provide accurate, current, and complete information during registration and usage. We reserve the right to suspend or terminate your account if any information is found to be false or misleading.
3.3 You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. Metro Mart shall not be liable for any unauthorized use of your account.
3.4 You agree to use the Platform only for lawful purposes and shall not attempt to misuse, hack, reverse engineer, or disrupt any part of the Platform.
PERSONAL DATA
4.1 We process your personal data in accordance with our Privacy Policy. By using the Platform, you consent to the collection, storage, and processing of your information as outlined in our Privacy Policy. If you do not agree, please refrain from using the Platform.
REPRESENTATIONS AND WARRANTIES
5.1 The Platform is provided on an “as-is” and “as-available” basis. Your use of the Platform is at your own risk. We disclaim all warranties, express or implied, including but not limited to merchantability and fitness for a particular purpose.
We shall not be liable for:
- Any personal injury or property damage arising from your use of the Platform
- Unauthorized access to your data
- Interruptions or errors in service
- Loss or damage resulting from reliance on Platform content
5.2 Metro Mart maintains a grievance redressal mechanism and will acknowledge complaints within 48 hours and aim to resolve them within a reasonable time as per applicable laws.
5.3 As an e-commerce platform, we ensure that customer consent for purchases is obtained through explicit actions.
5.4 Refunds, if applicable, will be processed in accordance with applicable laws and within a reasonable time.
5.5 We do not engage in unfair pricing practices or discrimination between users.
